Beta testing phase
Carbol is currently in closed beta. These terms are operative and legally binding. They are being reviewed by a lawyer before general public release and may be updated. Continued use of the app following any update constitutes acceptance of the revised terms. If you do not agree to these terms, do not use Carbol.
1. About Carbol
Carbol is a carbohydrate estimation and meal logging tool designed to assist people managing Type 1 diabetes. It is operated by Stephen Killgour, trading as Insightly ("Carbol", "we", "us", "our"), based in New Zealand.
By creating an account or using Carbol, you ("you", "user") agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
2. Not medical advice — critical disclaimer
Read this section carefully.
Carbol is an estimation and logging tool. It is not a medical device, is not approved or regulated as a medical device in New Zealand or any other jurisdiction, and does not constitute medical advice of any kind.
Carb estimates and insulin unit suggestions produced by Carbol are starting points for your own consideration only. They may be inaccurate. They are generated by an artificial intelligence model and have not been validated in clinical trials. Factors including food preparation method, portion size estimation, individual metabolic variation, and illness can all materially affect actual carbohydrate content and insulin response.
You are required to apply your own clinical judgment before making any dosing decision. Carbol is designed with a human-in-the-loop confirmation step: you must actively confirm every estimate before it is logged. You should never dose insulin based solely on a Carbol estimate without first considering your current blood glucose reading, recent activity, meal content, and the advice of your healthcare team.
Before using Carbol, you confirm that you have discussed the use of a carbohydrate estimation and insulin dosing calculator with your diabetes care team (endocrinologist, diabetes nurse, or general practitioner).
Carbol is not intended for use in emergencies. If you are experiencing symptoms of hypoglycaemia or hyperglycaemia, treat immediately using your established care plan and seek medical assistance if required.
3. Eligibility
You must be at least 18 years of age to create a Carbol account. If you are under 18, a parent or legal guardian must create the account and supervise your use. By registering, you confirm that you meet these requirements.
4. Beta software
Carbol is currently in a beta testing phase. The software is provided for testing and feedback purposes. It may contain bugs, errors, or inaccuracies. Features may change, be removed, or become unavailable without notice. We make no guarantee of uptime, accuracy, or continuity of service during this period.
By participating in the beta, you acknowledge these limitations and agree to provide feedback to help improve the product. Feedback may be sent to steve@carbol.co.nz.
5. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at steve@carbol.co.nz if you believe your account has been compromised. We are not liable for any loss resulting from unauthorised access to your account.
You agree not to share your account with others, create accounts by automated means, or attempt to access another user's account.
6. Acceptable use
You agree not to:
- Use Carbol for any unlawful purpose or in violation of these Terms
- Attempt to reverse-engineer, decompile, or extract source code from the app
- Upload content that is harmful, fraudulent, or infringes the rights of others
- Attempt to circumvent any security or access control measures
- Use the service in a manner that places unreasonable load on our infrastructure
- Resell or sublicense access to the service
7. Trial and subscription
New accounts receive a 7-day free trial with up to 5 entries per day, no payment required. After the trial period, continued access requires a paid subscription.
Subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time; your access will continue until the end of the current billing period. We do not offer refunds for partial billing periods except where required by applicable New Zealand consumer law.
During the beta testing phase, pricing, plan features, and trial terms may be adjusted. We will provide reasonable notice of material changes.
8. Your data
You retain ownership of all data you submit to Carbol, including meal photos, voice recordings, and health-related entries. You grant us a limited, non-exclusive licence to store and process this data solely for the purpose of providing the service to you.
We do not sell your data. We do not use your personal health data to train AI models. AI analysis is performed via the Anthropic API; images and transcripts are transmitted for processing and are not retained by Anthropic beyond the immediate API call.
You can export or delete your data at any time from within the app settings. On account deletion, all personal data is permanently removed within 30 days.
9. Limitation of liability
To the maximum extent permitted by New Zealand law:
- Carbol is provided "as is" and "as available" without any warranty, express or implied, including warranties of fitness for a particular purpose, merchantability, or non-infringement.
- We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the service.
- We are not liable for any loss, injury, or adverse health outcome arising from insulin dosing decisions made in connection with use of the service, including hypoglycaemia, hyperglycaemia, or diabetic ketoacidosis.
- Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total fees paid by you to Carbol in the 12 months preceding the claim.
Nothing in these Terms excludes liability for death or personal injury caused by our gross negligence or fraud, or any liability that cannot be excluded under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where those Acts apply.
10. Indemnification
You agree to indemnify and hold harmless Carbol, its operator, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the service; (b) your violation of these Terms; (c) your dosing decisions made in connection with the service; or (d) your violation of any rights of another person.
11. Intellectual property
All software, design, branding, and content forming part of Carbol (excluding your personal data) are owned by or licensed to us. These Terms do not grant you any rights to our intellectual property other than a limited right to use the service for its intended purpose.
12. Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, or for operational reasons during the beta period. You may close your account at any time from the app settings.
On termination for any reason, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability and indemnification) will continue to apply.
13. Changes to these terms
We may update these Terms from time to time. We will notify registered users of material changes by email. Continued use of the service after the effective date of any update constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the New Zealand courts.
